Terms of Service
These terms govern the supply of freight, load handling and logistics lounge services by The Load Lounge Pty Ltd (ABN 93 701 441 974) throughout Perth, Western Australia.
1. About these Terms
These Terms of Service (“Terms”) apply to all services supplied by The Load Lounge Pty Ltd (ABN 93 701 441 974) (“The Load Lounge”, “we”, “us” or “our”), including freight coordination, load handling and logistics lounge services described on our services page. By engaging us, accepting a quote, or using our website at theloadlounge.site, you agree to be bound by these Terms.
If there is any inconsistency between these Terms and a signed service agreement or written confirmation we issue for a particular engagement, the signed agreement or written confirmation will prevail to the extent of the inconsistency.
2. Definitions
- Services
- Freight coordination, load handling, pallet movement, warehousing support and logistics lounge services supplied by us, as described in your quote or booking confirmation.
- Goods
- Any freight, cargo, pallets, equipment or other items you entrust to us in connection with the Services.
- Booking
- A confirmed request for Services accepted by us in writing, including by email.
- Australian Consumer Law
- Schedule 2 of the Competition and Consumer Act 2010 (Cth).
3. Our Services
We provide freight coordination, load handling and logistics lounge services to businesses and individuals across the Perth metropolitan area and selected regional destinations in Western Australia. Descriptions of our services on this website, in brochures or in marketing material are general in nature. The specific scope of the Services applicable to your engagement will be set out in your quote, booking confirmation or service agreement.
While we take all reasonable care in planning and coordinating movements, scheduling times communicated to you are estimates only, and we do not guarantee that freight movements will occur at exact times, as road conditions, site access and third-party carriers can affect timing.
4. Quotes and Engagement
- Quotes provided by us are valid for the period stated in the quote, or 14 days if no period is stated, and may change after that period due to fuel costs, labour availability or other input costs.
- Quotes are based on the information you provide, including load dimensions, weight, access conditions and service location. If that information proves inaccurate or changes, we may adjust the price accordingly and will notify you before proceeding.
- A quote is an invitation to treat only. An engagement arises when we accept your booking in writing and issue a booking confirmation.
- Unless otherwise stated in writing, quoted prices are exclusive of GST and any tolls, levies, permits, parking fees or site access charges that are properly attributable to the Services.
5. Bookings and Scheduling
Bookings should be made with as much notice as practicable. While we will make reasonable efforts to accommodate preferred dates and times, scheduling is subject to equipment and crew availability. We will confirm your booking window in writing and will notify you as soon as reasonably possible if a delay or change is expected.
6. Payment Terms
- Unless otherwise agreed in writing, invoices are payable within 7 days of the invoice date.
- We may require a deposit or full prepayment before commencing certain Services, and we will always tell you this before you confirm your booking.
- Overdue amounts may attract interest at 2% per annum above the Reserve Bank of Australia cash rate, calculated daily, and we may suspend Services until outstanding amounts are paid.
- You must pay us in full without set-off or deduction, except where you have a genuine dispute and applicable law requires otherwise.
- If you believe an invoice contains an error, you must notify us in writing within 14 days of the invoice date so we can investigate promptly.
7. Cancellations, Variations and Delays
- You may cancel or reschedule a booking by contacting us at ceo@theloadlounge.site. We ask for at least 24 hours' notice. Cancellations made with less than 24 hours' notice may attract a reasonable fee to cover crew and equipment commitments already made.
- We may need to vary or reschedule a booking due to weather, road closures, site access issues, equipment failure or the actions of third-party carriers. Where practicable, we will offer an alternative time at no additional cost, or a refund of any prepaid amounts for Services not delivered.
- If we are delayed at a site because of circumstances within your control, including poor access, unavailable loading docks or unsafe conditions, waiting time may be charged at our standard hourly rate as disclosed in your quote.
8. Your Obligations
When engaging our Services, you agree that you will:
- provide accurate and complete information about your Goods, including weight, dimensions, fragility and any special handling requirements;
- ensure safe and lawful access to all collection and delivery sites, including adequate parking for vehicles where required;
- declare any hazardous, refrigerated, high-value or time-critical Goods before booking;
- ensure Goods are packed, secured, labelled and palletised in accordance with accepted industry practice and applicable laws; and
- ensure a responsible person is available at each site where required, or provide us with clear written instructions.
9. Prohibited and Restricted Goods
You must not consign illegal, dangerous or prohibited goods, including unclassified dangerous goods, illicit substances, firearms, live animals, perishables without prior arrangement, or any Goods whose transport would breach Australian law or carrier requirements. We may refuse or discontinue handling of any Goods we reasonably believe are unsafe, improperly declared or unlawful, and you remain liable for fees incurred up to that point.
10. Insurance and Risk
- Risk in Goods remains with you at all times unless we agree otherwise in writing.
- We maintain appropriate insurances for our operations. However, we strongly recommend that you arrange your own transit or marine cargo insurance for Goods of significant value, as our liability for loss of or damage to Goods is limited under clause 11.
- You must notify us of any loss of or damage to Goods within 48 hours of delivery or, for nondelivery, within 7 days of the expected delivery date. Claims notified outside these periods may be declined.
11. Liability
To the fullest extent permitted by law, our aggregate liability to you for any claim arising out of or in connection with the Services, whether in contract, tort (including negligence), statute or otherwise, is limited to the fees paid by you for the Service giving rise to the claim, except where the loss arises from the Australian Consumer Law guarantees described in clause 12, or from our wilful misconduct or fraud.
We are not liable for indirect, incidental, special or consequential loss, including loss of profits, loss of business, loss of data or loss of opportunity, however caused.
12. Australian Consumer Law — Your Rights
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law that cannot be excluded, restricted or modified. Our Services come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Services remedied or resupplied if the Services fail to be of acceptable quality and the failure does not amount to a major failure.

13. Indemnity
You indemnify us, our directors, employees and contractors against all losses, claims, damages and reasonable costs arising from: (a) your breach of these Terms; (b) inaccurate information you provide about Goods or sites; (c) Goods that are illegal, improperly packed or undeclared; or (d) your negligence at a site, except to the extent caused by our negligence or breach of these Terms.
14. Force Majeure
We are not liable for failure or delay in performing the Services to the extent caused by events beyond our reasonable control, including severe weather, natural disasters, industrial action, government restrictions, cyber incidents or failures of third-party carriers or utilities. We will notify you of such events and resume performance as soon as reasonably practicable.
15. Privacy
We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). By engaging our Services, you consent to the collection, use and disclosure of information as described in that policy, including disclosure to carriers and subcontractors as necessary to deliver the Services.
16. Website Use
The content of this website, including text, branding and layout, is owned by or licensed to The Load Lounge Pty Ltd and is protected by copyright. You may view and print pages for your own records but must not reproduce, adapt or commercially exploit our content without written permission. Information on this website is general in nature and does not constitute professional advice for your specific circumstances.
17. Governing Law and Disputes
These Terms are governed by the laws of Western Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.
If a dispute arises, we ask that you first contact us at ceo@theloadlounge.site so both parties can attempt to resolve the matter in good faith through discussion before commencing formal proceedings.
18. Changes to these Terms
We may update these Terms from time to time. The current version will always be published on this page with a revised “Last updated” date. The Terms in force at the time you confirm a booking will apply to that engagement, unless we agree otherwise in writing.
